Terms & Conditions

This Terms and Conditions, along with the Privacy Policy (incorporated herein) (together the “T&C”), is a binding agreement between The Times Centre for Media and Management Studies, The Times School of Journalism and The Times School of Marketing and Management (hereinafter jointly referred to as “Times School”/ “we”/ “us”/ “our”) and the end user (“you”/ “user”/ “visitor”) accessing this website www.timesmediastudies.com (“Site”) and its content. This T&C is an electronic record under Information Technology Act, 2000 and the rules there under as applicable and the amended provisions pertaining to electronic records in various statutes under applicable Indian laws. This electronic record is generated by a computer system and does not require any physical or digital signatures.

Your use of services/Site are subject to your acceptance of any compliance of this T&C and by subscribing to the services or using the Site you agree that you have read and understood the T&C.

Further, by clicking on the “I Accept” button at the end of the T&C and/or making the payment through the link provided herein, you hereby agree to be governed and bound by, this T&C. You confirm that you are entitled to enter into any contract and are aged 18 years and above.

Times School may add to or change or update these T&C, from time to time entirely at its own discretion. However, any changes to the T&C, will be updated/posted on the Site and we may also inform you of such changes through your registered email address. You are responsible for reviewing these T&C periodically to remain in compliance with these T&C and Your use of a Site after any amendment to the T&C shall constitute your acceptance of the changes.

 

Registration

For certain services such as payment of online examination fees, student verification charges, documentation charges, issue of duplicate certificate in lieu of lost certificate, filling up of online application by you, you will have to complete the registration process (i.e. by providing us with current, complete and accurate information as prompted by the applicable registration form).

Upon registration you will be provided with a user ID and a password (the password needs to be changed during the first log in). You agree and understand that you are responsible for maintaining the confidentiality of passwords associated with any account you use to access the Site and/or any services offered through the Site.

If you become aware of any unauthorized use of your password or of your account, you agree to notify Times School immediately at tsj@timesgroup.com. You are responsible for any misuse of services that occurs through your user account or under your control or supervision. It is your responsibility to ensure that unauthorised persons do not gain access to or misuse the services/Site and We shall not be responsible for any losses arising out of the unauthorized use of your user account.

 

Payment and Taxes
 You can make any payment through Demand Draft drawn in favour of “The Times Centre for Media and Management Studies”. The payments may also be made online through credit card, debit card and net banking. You understand that upon clicking on the digital mode of payment opted by you, you will be migrated to third party sites and such third party sites may have their own respective terms and conditions to which you will be bound and Times School shall have no responsibility whatsoever arising from your usage of such third party sites.
 You shall be responsible for payment of all fees/costs/charges associated with the purchase of applicable forms/registration fees from us and you agree to bear any and all applicable taxes/ cesses/banking charges etc. levied thereon.
 Times School or its payment gateways will not be liable for any loss that you may incur as a result of someone else using your credit/debit card and/or net banking account information.

 

Cancellation/Refund Policy

Fees/charges once paid are not refundable under any circumstances. Please be aware that a successful transaction in which an application ID / order ID is generated, no cancellation can be made. However, if in a transaction performed by you on the Site and multiple debit has been made on your card / account, for a single transaction, then you may inform us by sending an email to tsj@timesgroup.com. We, Times School, along with our payment gateway partner, shall investigate the incident. If the investigating team finds that you have been charged multiple times for a single transaction/service, then the refund shall be processed within 21 business days from the date of receipt of your request. All refunds will be credited to the source of the payment. Once the refund is processed from our side, it may take upto 21 days for the money to reflect in your account, depending on your bank's policy.

 

User Conduct and Rules

You agree and undertake to use the Site and the service in accordance with this T&C and shall not (i) violate any applicable laws, rules or regulations in connection with your access to or use of the Site (ii) use any of our proprietary information, interfaces or other intellectual property in the design, logo, mark of Times School and/or its affiliates (iii) post, upload any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information; (iv) upload files that contain software or other material protected by intellectual property laws unless you own or control the rights thereto or have received all necessary consents; (v) upload or distribute files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of the Website or another's computer; (vi) falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded; (vii) violate any code of conduct or other guidelines, which may be applicable for or to any particular service.

 

User Warranty and Representation

The user guarantees, warrants, and certifies that you are the owner of the content, which you submit or otherwise authorized to use the content, and that the content does not infringe upon the property rights, intellectual property rights or other rights of others. You further warrant that to your knowledge, no action, suit, proceeding, or investigation has been instituted or threatened relating to any content, including trademark, trade name service mark, and copyright formerly or currently used by you in connection with the services rendered by Times School.

 

Privacy Policy

Times School will use any personal information that you provide to us while registering yourself on the Site or using the Site or part thereof, in accordance with applicable laws and for any marketing or other purposes. Times School may also share such information(s) with its affiliates, its service providers and agents in connection with Times School and/or its affiliates business operations which may include:
• processing your application(s)
• recommending various products or services including those of third parties
• dealing with your requests, enquiries and complaints and related activities
• marketing products and services and its analysis
• abiding with laws and law enforcement / regulatory requests
We may provide links to third-party web sites or applications or services to you. This policy does not address, and we are not responsible for, the privacy practices of web sites or applications or services operated by third parties. The accessibility to third party web sites or application or services does not imply endorsement of such third party web site or application or services by Times School.

 

Disclaimer of Warranties / Limitation of Liability

Times School has endeavored to ensure that all the information on the Website is correct, but the Times School neither warrants nor makes any representations regarding the quality, accuracy or completeness of any data, information, product or service. THE SITE OR ANY CONTENT OR ANY MATERIAL THEREOF, ARE PROVIDED ON AN “AS-IS” AND “WITH ALL FAULTS AND RISKS” BASIS, AND WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED UNDER LAWS, TIMES SCHOOL DISCLAIMS ALL WARRANTIES WHETHER EXPRESS OR IMPLIED INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR THAT USE OF THE SITE OR ANY PART THEREOF WILL BE UNINTERRUPTED OR ERROR-FREE. WHERE THE LAW DO NOT ALLOW THE EXCLUSION OR THE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH JURISDICTIONS, TIMES SCHOOLS'S LIABILITY SHALL BE LIMITED TO THE EXTENT PERMITTED BY LAW AND IF ANY SUCH LAW PROVIDES FOR LIMITATION OF LIABILITY THEN TIMES SCHOOL’S MAXIMUM AGREGGATE LIABILITY AND YOUR SOLE AND EXCLUSIVE REMEDY AGAINST TIMES SCHOOL SHALL BE LIMITED TO THE PAYMENT RECEIVED BY TIMES SCHOOL FROM YOU.

 

Limitation of damages

In no event shall Times School or any of its holding, subsidiaries, sister companies, joint-ventures or affiliates be liable to any entity for any direct, indirect, special, consequential or other damages (including, without limitation, any lost profits, business interruption, loss of information or programs or other data on your information handling system) that are related to (i) the use of, or the inability to use, the content, materials, services and functions of the Site or any linked web site (ii) unauthorized access to or alteration of the user's transmissions or data; (iii) any other matter relating to the services; including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the Site or service.

 

Indemnification

You agree to indemnify, defend and hold harmless Times School and/or its affiliates their respective directors, officers from and against any and all losses, liabilities, claims, damages, costs and expenses (including legal fees and disbursements in connection therewith) asserted against or incurred by Times School and/or its affiliates that arise out of, result from, or may be payable by virtue of, any breach or non-performance of any representation, warranty, covenant or agreement made or obligation to be performed by you pursuant to these T&C’s for all the activities that occur through your account.

 

Governing Law

These terms shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts at Delhi.

 

Severability

If any provision of the Terms is determined to be invalid or unenforceable in whole or in part, such invalidity or unenforceability shall attach only to such provision or part of such provision and the remaining part of such provision and all other provisions of these Terms shall continue to be in full force and effect.

 

Shipping / Delivery of Services

All our services are online. No physical delivery will be carried out for any of the services availed. You will receive an email on your registered email address, once a service is availed, confirming the service transaction.

 

Force Majeure

Times School shall be under no liability whatsoever to You in the event of non-availability of any portion of the Site occasioned by Act of God, war, civil commotion, strike, lockout, infrastructure failure or any other cause whatsoever beyond the control of Times School.

 

Entire Agreement

The T&C contains the entire understanding and supersedes all prior understandings between the Parties relating to the subject matter herein.
